1. Agreement to These Terms

By accessing the WebNismo website, you agree to comply with these terms. When you commission a project or purchase a service, a separate written agreement will also apply and will take precedence where it conflicts with these terms.

2. Our Services

WebNismo provides digital services including:

• Website design and development.
• Mobile application development.
• Branding and graphic design.
• Website maintenance and technical support.
• Other digital services agreed with clients in writing.

Specific scope, deliverables, pricing, timelines, and support arrangements are confirmed in a separate project agreement before work begins.

3. Enquiries and Quotations

Sending an enquiry does not create a service contract. Any quotation we provide is an estimate based on the information you supply at the time, and may have an expiry date. A contract begins only when both parties have agreed the project terms in writing.

4. Payments

Fees, deposit requirements, payment schedules, and any cancellation conditions will be stated in the project agreement. Work may be paused if payments are overdue. Your mandatory statutory rights remain unaffected.

5. Client Responsibilities

To allow us to deliver your project on time, you agree to:

• Provide accurate and complete project information.
• Supply required content, materials, and approvals promptly.
• Confirm that you hold the necessary rights to any text, images, logos, or other materials you supply.
• Review deliverables and report issues in a timely manner.

Delays caused by late content, feedback, or approvals may affect the agreed delivery schedule.

6. Intellectual Property

On receipt of full payment, you will own the custom deliverables created specifically for your project, as set out in the project agreement. WebNismo retains ownership of its pre-existing tools, reusable components, frameworks, and development methods.

Third-party assets, libraries, fonts, and open-source software remain subject to their respective licences. We will advise you of any third-party components included in your project.

7. Acceptable Website Use

You must not use our website for unlawful purposes, attempt unauthorised access to our systems, introduce malicious code, scrape or copy our content without written permission, or interfere with other visitors' use of the website.

8. Third-Party Links

Our website contains links to external websites, including our social media profiles. These links are provided for convenience only. We do not control the content, availability, or privacy practices of any external website. Visiting a third-party website is at your own risk and subject to that site's own terms.

9. Disclaimers and Liability

We aim to deliver our services with reasonable care and skill. Our website is provided on an "as available" basis without warranties of any kind.

To the extent permitted by law, WebNismo is not liable for indirect, incidental, or consequential losses arising from your use of our website or from service delivery. Nothing in these terms excludes liability that cannot legally be excluded or limited.
